Filing a criminal complaint for a company or sole proprietorship

If your company has been the victim of a crime and you intend to lodge a complaint, there are a few important points to focus on.

Ideally, the person who goes to the police to lodge the complaint should have the company’s individual signature or be the holder of a sole proprietorship.

If this is not the case, even if the case law of the Federal Court is relatively flexible, it will be necessary for the managing director, or equivalent body, to deal with the matter, or for the person handling the complaint to have power of attorney.

To repair the damage, it’s important to keep all invoices, whether for repairs, stolen items or any other costs incurred as a result of the offence.

In the same way, it’s up to you to take out any insurance that covers the type of damage you’re dealing with.

If the insurance covers the damage, it’s important that you personally submit only the remaining costs, such as uncovered costs or the deductible, in the criminal proceedings.
